These Terms of Service (“Terms”) govern your access to and use of the Pandahrms human-resource, payroll and attendance software and related websites, mobile applications and services (the “Service”), operated by Pandaworks Sdn Bhd (“Pandaworks”, “we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
Pandahrms provides cloud-based HR, payroll, attendance and related workforce-management tools. We may add, change or remove features over time to improve the Service.
2. Accounts
You are responsible for the activity under your account and for keeping your login credentials confidential. You must provide accurate information and are responsible for ensuring that the people you add to the Service are authorised to be added.
3. Acceptable use
You agree not to misuse the Service, including by attempting to access it using a method other than the interface and instructions we provide, interfering with or disrupting the Service, or using it to store or transmit unlawful, infringing or harmful content.
4. Customer data and privacy
You retain ownership of the data you submit to the Service. We process personal data in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010 (PDPA). You are responsible for obtaining any consents required from your employees for the data you upload.
5. Subscriptions and fees
Paid plans are billed on the cycle shown at sign-up. Fees are exclusive of applicable taxes unless stated otherwise. Unless required by law, fees are non-refundable for the period already started.
6. Third-party services
The Service may link to or integrate with third-party services (for example social-media platforms, statutory portals or payment providers). Your use of those services is governed by their own terms, and we are not responsible for them.
7. Availability
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, security or legal reasons.
8. Intellectual property
The Service, including its software, design and content (excluding your data), is owned by Pandaworks and its licensors and is protected by applicable law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
9. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Pandaworks will not be liable for indirect, incidental or consequential losses, and our total liability arising from the Service is limited to the fees you paid for the Service in the twelve months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. On termination, we retain and then delete data in line with our Privacy Policy (data is deleted 60 days after account termination).
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will provide notice through the Service or website. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them.
